Colorado Probate

The attorneys at Willoughby & Associates specialize in Colorado probate law. Probate is the legal process by which a will is proved to be valid or invalid, or a person is determined to have died intestate, and an estate is administered. A personal representative is appointed to handle the administration. Assets are identified, collected and, if necessary, valued. Taxes and debts are paid. Assets that did not pass to another by a non-probate transfer are distributed to heirs. All of this is done through the courts. However, the process can be informal and unsupervised.

Some estates are not complex and can go through the Colorado probate process fairly quickly and easily. Nearly 90 percent of estates are administered without court supervision in Colorado.

Other estates are more complex and take longer to be fully administered and the personal representative discharged.
